First successful step - is a DATA BACKUP.
1st important step is to secure your data first - prevent destruction of primary evidence..! Data should be inside & intact with its date/time details where it was created / generated..!
Primary evidence means your original mobile phone along with data, where data evidences originally captured / recorded / SMS's being received etc. or it be like CCTV videos with DVR & inside hard drive.. Electronic evidence i.e. mobile/CCTV/emails etc. Whenever you feel that it is an important piece of evidence in your upcoming court case or ongoing dispute, It is essential to immediately take a backup of the device / data right away and preserve it securely.
Most of the time data on various reasons get corrupted or disappeared, like accidentally
deleting or software of device gets corrupted or virus intrusion. That time, a data backup gives you
relief, with device restored with your all data back, instead of heavy price data recovery which is non-reliable & most the time it is failed to recover data.
Second successful Step - is a DATA SORT.
Before directly going to make transcription or presenting the data in any form, or getting a 65B / 63 BSA certificate, it is important to check whether your selected evidence data is legally useful..? The data should be analyzed in legal point of view to confirm that it is related to the case.
For instance, if you have too many data / repeated / similar / content of evidence, you must choose only most effective once..! Data analysis is more important, than presenting every data.
Important- Do not sort data on your original device, let copy on some another device / pen drive then you can analyze it. i.e. Like audio recordings sorting / listening on original phone it may get deleted while doing analysis..!
Third Successful Step - is to decide DATA PRESENTATION .
Answer in 1 line - If you have merit data evidence & you want to convince the judge, that data is true and not an artificial or a fake one.. Also it was created in natural process in the past..!
Presentation of data - meaning we have to convince the court quickly in a stipulated time, that your merit evidence without opening actual data files as we know Courts are packed with overload of cases pending and therefor it is required your data evidence to be stand ready for anytime of arguments required to show it easily..! That only possible when a Document of Presentation is keep ready with thoroughly marked details, it is access of clarification for court.. There are variety of presentations like - Transcriptions, Video/ Photo Explanations, charts big text of chatting history etc., data given only with CD / Pen Drive isn't good option.
